Service and Project Terms 

This Client Service Agreement (the “Agreement”) is made and entered into by and between About Design, located at Office Nu. 304, 3rd floor, Sheetal Ekta opposite Oberoi Mall, Film City Road, Malad East, Mumbai 400097 (hereinafter referred to as “About Design” or “Company”), and the client engaging the design services (hereinafter referred to as “Client”).

1. Project and Order

A “Project” refers to a home or office design undertaking for a single home or office. Multiple orders can be placed under a single project, such as one order for modular products and a separate order for services such as civil work. Payments are processed at the order level, and About Design will not execute any project where the total order value is below INR 6 lakhs.

2. Types of Services

  • Design Consultancy Only: Under this service, About Design provides design consultancy while the client appoints a contractor to execute the work. About Design holds no liability for the actions, quality, or timelines of the appointed contractor.
  • Design & Build: This service includes the complete ownership of About Design in both the design and execution, ensuring end-to-end project delivery, subject to the terms herein.

3. Refunds

Once the project is booked, the client has a 36-hour preview window to cancel the project. After this period, no refunds will be issued

4. Booking Fee

A 10% booking fee is required and will be adjusted against future orders. If the project scope increases, an additional 10% of the revised scope must be paid prior to initiating new design work.

5. Execution Stages

Execution stages mark the completion of significant activities, at which point the balance payment for that order type is due. About Design will proceed with the rest of the order only after payment for the respective stage is received.

6. Estimated Project Quote

The project quote is indicative and may change based on design choices, products, materials, colors, and services. If the project scope or value changes at the execution stage, any free gifts or discounts offered during sale shall be withdrawn. Quotes at the 10% booking stage are valid for 60 days, while other quotes are valid for 21 days.

7. Delivery Time

Delivery dates are subject to change based on order modifications, factors beyond About Design’s control, or force majeure events. The order will be delivered on or before the assured delivery date, barring such unforeseen circumstances.

8. Order Placement Stage

Orders for About Design furniture and decor items are placed at this stage. Civil work and custom furniture manufacturing are initiated according to defined execution stages. All work will commence only after a 50% payment has been processed.

9. Post-Sales Service

  • During Execution: Free service requests for any manufacturing defects.
  • Within 30 Days of Project Completion: Unlimited free service requests.
  • Between 30 Days and 6 Months Post-Completion: One free service request.

Beyond 6 Months Post-Completion: Services will be chargeable.

10. Modular Delivery & Warehousing

Where About Design’s scope includes only modular products, the Client must confirm material delivery dates based on site readiness. If the site is not ready for delivery, materials will be stored for up to 10 days free of charge; beyond that, a warehousing charge of INR 500 per day will apply.

11. Delay Penalties

About Design will be liable to pay a delay penalty of INR 500 per day for delays exceeding 15 working days from the confirmed handover date. The delay penalty is capped at 3% of the total project value and only applies if the Client has adhered to all payment schedules.

12. Invoicing

Invoices for design services, products, and other services will be issued by About Design. For branded products, invoicing will be done by authorized sellers or distributors. Contact your About Design representative for any invoicing queries.

13. Governing Law, Jurisdiction, and Dispute Resolution

  • In case of any dispute, the parties will first attempt amicable resolution through mutual discussions.
  • If unresolved within 30 days, disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings in English at Mumbai. Arbitration costs are borne equally.

This Agreement is governed by the laws of India, and courts in Mumbai shall have exclusive jurisdiction.

14. Cancellations and Returns

  • At the design stage, items in the tentative BoQ can be replaced or removed. However, once an order is placed, no cancellations, modifications, or returns will be accepted.

Products with non-manufacturing defects or damages post-delivery are not eligible for returns or replacements.

15. Quality Promise

About Design ensures multiple quality checks at every stage. Marketplace furniture and decor products are covered under manufacturer warranties, where applicable.

16. Marketplace Products

Products sold via marketplace arrangements with About Design partners are referred to as “marketplace products.” Any guarantees or warranties are provided directly by the Service Partners, and About Design does not assume liability for marketplace product quality.

17. Disclaimer

  • About Design acts as a facilitator for marketplace transactions and cannot be held liable for indirect, incidental, punitive, or consequential damages arising from quality issues with marketplace products.
  • Clients should reach out to About Design representatives to understand the terms regarding marketplace product guarantees and warranties.
